TERMS OF SERVICE

TERMS OF SERVICE AGREEMENT  PLEASE READ THE FOLLOWING TERMS OF SERVICE AGREEMENT CAREFULLY. BY ACCESSING OR USING OUR SITES AND OUR SERVICES, YOU HEREBY AGREE TO BE BOUND BY THE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IT IS THE RESPONSIBILITY OF YOU, THE CUSTOMER, OR PROSPECTIVE CUSTOMER TO READ THE TERMS AND CONDITIONS BEFORE PROCEEDING TO USE OUR SITE OR OUR SERVICES. IF YOU DO NOT EXPRESSLY AGREE TO ALL OF THE TERMS AND CONDITIONS, THEN PLEASE DO NOT ACCESS OR USE OUR SITES OR OUR SERVICES. THIS TERMS OF SERVICE AGREEMENT IS EFFECTIVE AND UPDATED AS OF 07/03/2024.  

Payment Terms
The client shall pay 50% of the total contract value within ten (10) business days of the acceptance and invoicing of the agreement by AAGTE (All Access Executive Solutions, DBA All Access GTE).  Final payment must be made 120 days before the commencement of a scheduled International Trip and 90 days prior to an Event. Reservations made within 120 or 90 days are subject to full payment upon confirmation.  Failure to remit such payments shall constitute a cancellation of the agreement by the client and potential loss of the itinerary or event.  By submitting payment you are acknowledging any and all purchases and agree to the applicable terms and conditions outlined within. AAGTE reserves the right to adjust these payment terms as needed.

Cancellation Policy
Cancellations must be submitted in writing to AAGTE and are subject to the following charges. Cancellations made by a client outside of 120 days prior to the trip or event start date will forfeit fifty percent (50%) of the total contract value, plus any non-refundable penalties imposed by our suppliers. Cancellations inside of 120 days prior to the trip or event start date will forfeit one-hundred percent (100%) of the total contract value, plus any non-refundable penalties imposed by our suppliers. If a member(s) of a party cancels, the total package price may impact the remaining members pricing.  The client agrees that failure to pay any applicable cancellation fees within (10) ten days will immediately trigger AAGTE right to recover as a debt the monies owed.  The parties acknowledge this provides reasonable liquidated damages and is not a penalty, and bears a reasonable relation to the damages AAGTE will sustain.

Refunds
Any refunds due for cancellations will be issued within 120 days of written notice. Unused or partially-used trip and event items are non-refundable. There will be no refunds for any absence from all or any portion of the trip or event once it commences.

Changes & Late Fees
Any changes made after the deposit has been paid are subject to a fee of $100 per change, in addition to any penalties charged by our suppliers.  Any changes requested within 120 days of the trip or event start date, are subject to the policies and availability of our service providers. Failure to submit payment on time will be subject to a late fee of $100 and subject to the loss of the itinerary.

Group Sign-Ups & Pricing
Itineraries are contingent upon availability at the time of booking. Upon payment notice, a non-refundable deposit amounting to 50% of the total trip cost is required within 48 hours to secure the proposed itinerary. Any delays in assembling the group or failure to collect payments from all registered group members may result in modifications to, or the forfeiture of, the itinerary. Upon receipt of all deposits and the finalization of group arrangements, the booking process for the proposed schedule will be initiated. Any alterations to the itinerary at the time of booking will be promptly communicated to the group. Pricing is subject to adjustment based on the release of future rates for itineraries booked more than six months in advance.

Travel Responsibilities
All Access GTE will not assume responsibility for any delay or damage to or loss of property or injury to or death of persons due to transportations (rental car, motorcoach, railroad, air flight, or any other conveyances), or due to suppliers (accommodations, golf courses, restaurants), or due to any other external reasons (strikes, pandemics, weather conditions, etc). If during the trip, any of the service providers (hotels, restaurants, golf clubs, transportation, etc.) do not provide the agreed services, clients must submit a written claim to All Access GTE within 30 days of the end of the stay. There will be no refunds for any unused portions of the program. The client also acknowledges having the necessary golf skills to play on the golf courses reserved. The client plays golf on the course solely at your own responsibility towards others and the golf course. All Access GTE cannot be held responsible if the golf course cannot be used due to weather conditions or other unforeseen circumstances. Green fees will only be refunded if the golf course is unavailable for play.  Passports are required for U.S. citizens when traveling to most international destinations and should be valid for six months upon entry into the country.

Event Responsibilities
AAGTE agrees to provide the clients and designated nominees a full Sports Hospitality Package as described in the event marketing deliverables. Client information and passes will be distributed approximately four (4) weeks before the event.  Ticketing, if applicable, will be provided on the day of the event unless otherwise stated.  Any tickets referenced are merely an accommodation and the company acts only as an agent between the client and the original holder of the tickets and any arrangement to transfer tickets to a client will be within the conditions laid down by the event organizers.  It is understood that the tickets are not to be used as an inducement to buy hospitality services or facilities. AAGTE will make arrangements on the client's behalf for transportation, accommodation, restaurants or other services solely as the clients’ agent and does so on the express condition that no liability of any kind whatsoever caused shall attach to AAGTE in connection with or arising out of such arrangements. Should for any reason outside of the control of the company a day’s play or event be partly or wholly canceled for any reason including bad weather no refunds or credits will be given.  Individual companies may take out insurance coverage through its own broker and should a facility be destroyed or made unusable no refund will be given.  In the event of a postponement of an event of fewer than 8 months the client shall be entitled to elect to take a credit note to any future event.  AAGTE will make every effort to deliver the specific package as outlined and reserves the right to make non-material changes to the package in the best interest of the event, non-material changes include but are not limited to changes to locations and the hospitality program without penalty.  All accounts for services and goods provided at an event which are not covered by an inclusive package cost are due for payment within 20 days of receipt of the notice.  Client agrees to not hold AAGTE liable for any losses or costs incurred through the cancellation, postponement or alteration of the event.  The parties acknowledge and agree in advance that AAGTE invests considerable economic resources into producing the event and would sustain considerable economic loss as a consequence of such cancellation or alteration and therefore these paragraphs are reasonable in relation to the losses AAGTE would sustain which are uncertain and difficult to estimate at the time the agreement is made.  The client agrees to abide by the rules of the event facility. AAGTE and any of its facilities and services provided under this contract are totally independent of the event organizers and sponsors. The undersigned warrants and represents that he or she is specifically authorized by the client to execute the contract and bind the client to the obligations.  The client acknowledges that AAGTE has relied on that representation.

Pricing
Prices are based on the currency exchange rate at the time of booking and are subject to adjustments according to the currency exchange rate at the time of payment. Prices are guaranteed against fluctuation once payment is received.

Insurance & Airfare
We encourage our clients to obtain travel insurance to protect your trip.  AAGTE is not an insurance carrier and insurance must be purchased through a 3rd party vendor.  Airfare is not included in any packages unless specified otherwise.  Any issues associated with air travel, including refunds, must be addressed directly with the airline and will be at the discretion of the airline.

Force Majeure
AAGTE provides hotel, ticketing, hospitality, reservations, ground transportation, and all other services from third parties as a travel and ticketing agent.  If the planned event/vacation is postponed, cancelled, or relocated due to disaster, government action, acts of God, pandemics, strikes or labor unrest (other than by our employees), riot or civil disorder, acts of terrorism, inclement weather, transportation strike or other events beyond our control not anticipated or known by either you or by us at the time of your purchase of your package(s), our liability, if any, is and shall be limited to providing you with a replacement itinerary to the next or rescheduled trip or event, with any price adjustments as necessitated by change of date(s).  Once applied to a future booking, standard cancellation terms apply.

AAGTE may provide 3rd party links to other websites and/or resources. Thus, you acknowledge and agree that we are not responsible for the availability of any such external sites or resources, and as such, we do not endorse nor are we responsible or liable for any content, products, advertising or any other materials, on or available from such third party sites or resources.

Confidentiality
All information provided to the client in connection with this agreement, including the names of the participants is confidential and may not be shared with third parties without written consent of the other party.

Indemnity
To the fullest extent permitted by law, the client shall indemnify, defend and hold AAGTE (and its respective officers, directors, employees, agents, members, affiliates and subsidiaries) harmless from and against all claims, damages, losses, and expenses, whether direct, indirect, or consequential, including but not limited to all fees and charges of attorneys, court and arbitration costs, as a result of or relating to a breach of any provision of this Agreement by the client unless the act or omission had been specifically approved by the indemnitee. This provision shall survive the duration of this Agreement.

Governing Law, Arbitration, Disputes
This agreement shall be governed in accordance with the laws of New Jersey and the parties submit to the exclusive jurisdiction of the courts of the state of New Jersey.  Reserving a package and sending the initial deposit is and shall constitute the acceptance of this contract by you.  Both parties waive the right to trial by jury.  If AAGTE retains an attorney to protect its interests under this agreement, the client shall pay any and all costs and expenses incurred in enforcing any term or collection, including reasonable attorney’s fees, collection fees or expenses. Any fees or late payments may be subject to an interest corresponding to 5% above the Federal Reserve Base Rate.  If any provision of this agreement is deemed unenforceable the remaining terms shall remain enforceable to the fullest extent of the law.

Modifications
AAGTE shall reserve the right at any time it may deem fit, to modify, alter and or discontinue, whether temporarily or permanently, our service, or any part thereof, with or without prior notice. In addition, we shall not be held liable to you or to any third party for any such alteration, modification, suspension and/or discontinuance of our Services, or any part thereof.

Entire Agreement
This is the complete, final and exclusive binding contract between the parties relating to travel and supersedes all prior agreements, understandings, both written and oral, and may not be amended or altered after your initial deposit has been made except in writing, signed by all parties.  This agreement may not be assigned or shared with any third parties without the express written permission of an officer of AAGTE.

ACCEPTANCE OF TERMS AND CONDITIONS:
Payment by the client will be considered full acceptance of the above-mentioned terms and conditions.
